Terms & Conditions

Please read these terms carefully. These terms, as modified or amended from time to
time, are a binding contract between Prime Auctions LTD. ("Prime Auctions") ("we" and/or "us"
etc.) and you ("you", "bidder", "purchaser", “buyer”).

 

Registration & Identification
By registering or purchasing a buy now item you acknowledge that you have read, understood and agree to all the terms, conditions, rules and regulations stated below and anywhere else within the auction.
You certify that all the information you have provided in your registration for the auction is
truthful and accurate and that you will undertake the responsibility to update and maintain the
accuracy of these registration details (phone number, address, postal code, email). You
understand that if any information you have provided is deemed false by our staff or our auto
verification system that your account will be suspended or removed until it is further verified.
You must be at least 18 years old to register to bid. If you register to bid, you are responsible for
maintaining the confidentiality of your account and password and restricting access to your
computer and you agree to accept responsibility for all activities that occur under your account
and password.


When you pick up your items you will be asked to show ID to ensure it matches the information
on record. If you would like to identify an alternate person to pick up items on behalf of you,
you must notify Prime Auctions via e-mail at info@primeauctions.ca from the e-mail used to
register for the auction, or purchase the item. You must provide Prime Auctions with the first
and last name of the person authorized to pick up the items on your behalf. The person picking
up the items on your behalf will be asked to show ID and must match the information you have
provided to us.


Buy Now Items
Buy now items allow customers to purchase items without bidding on them and are subject to
the same terms and conditions as items purchased through an online auction.


Buy Now items can not be held for payment at a later date. Once a customer indicates they are
interested in purchasing an item, payment must be made within 24 hours. Items not paid for
within 24 hours will be released and available for purchase once again. Once items are paid for
they must be picked up within six (6) calendar days from the date of purchase at the designated
pick up location. Please refer to Pick Ups & Removals for details.


Irrevocable Bids

Bids are not revocable. Once a bid is placed, it cannot be removed. All items are sold as is,
where is, with all faults and with no assurances that any item is fit for a particular use. All bids
are legally binding and enforceable in Alberta, Canada.


For online bidding, please keep in mind that the connection to the internet is not absolutely
reliable. Connection problems can happen between or within our office, between or within the
software servers, and/or between or within bidders and potential bidders. We cannot be held
responsible for any of the above possible issues, or for your bids not making it into the system.


Maximum Bids
HiBid offers a process called “Maximum Bids” which you may elect to use when entering a bid.
Maximum bidding is an automatic bidding system. When you place a maximum bid, you enter
the maximum amount you would be willing to pay for the items. Your maximum amount is
kept confidential from other bidders. HiBid compares your bid to those of the other bidders
and automatically places bids on your behalf based on the minimum bid increment for the
specified item, and using only as much of your bid as is necessary to maintain your high bid
positions. HiBid will continue to automatically bid up to your maximum amount. If another
bidder bids a dollar amount that is higher than your maximum amount, you will be outbid and
notified (if there are more than 2 hours left in the auction). If no other bidder submits a higher
bid than your maximum amount at the time of closing, the items will be sold to you.
In the unlikely event of a dispute, you agree to accept as true the information that we have in
our records.


Catalogue Errors & Omissions
Written and oral descriptions are the opinions of Prime Auctions and should in no way be
construed as a guarantee of any kind as to authenticity, age, model, make, materials, condition
or any other feature of items being sold. Prime Auctions attempts to catalog every lot correctly
and will attempt to point out any defects but will not be responsible or liable for the
correctness of the catalog, item descriptions or pictures within. Questions regarding
item(s)/lots can be asked by emailing info@primeauctions.ca. Questions will only be answered
if received at least 24 hours prior to applicable auction closing. By placing a bid, in any capacity,
you signify that you have examined the items as fully as you desire and have had the
opportunity to ask questions and receive answers from Prime Auctions that you deem
adequate. If you are not satisfied with the information provided regarding any items or lots, do
not bid on the item(s)/lot in question.


All items are sold on an 'as is, where is basis' with all faults. Any listed retail values and/or
prices are approximations only. It is your responsibility to do your own due diligence in
researching values. Buyers are strongly encouraged to review the details of any lot they intend
to bid on. Bids cannot be retracted. Be aware that photographs may differ slightly from the

actual item(s). Where there is conflicting information between the item(s) details and the
photograph, the posted written details prevail.

Payments
All items up for auction are subject to the mandatory 16% buyers premium. This is added to the
winning bid amount which constitutes the final purchase price. The standard Canadian 5% GST
Tax and any applicable provincial sales tax is then calculated on top of this final purchase price.
All winning bidders will receive an e-mail invoice within 24 hours of the auction closing. Prime
Auctions does not take responsibility for buyers security on their email accounts. Be advised
that your email security may prevent our emails from going to your inbox. We encourage
bidders to mark our email address as safe. It is strongly advised to check on Hibid to see if you
have won your items. "MAY HAVE WON" means you HAVE won. It is the bidders responsibility
to identify if they have won items.


Payment for your items can be done by Cash, Debit, E-Transfer or Credit Cards (Mastercard or
Visa). All items sold are subject to tax legislation pursuant to tax laws of Alberta and other
Canadian provinces. All taxable items will be charged taxes as per the province that the items
are being shipped to.


All invoices must be paid in full within six (6) calendar days of auction close. Invoices that have
not been paid for within six (6) calendar days of auction close will automatically be charged to
the credit card that was used for auction registration.


By bidding on our auctions (and thus agreeing to our auction policies in our registration) the
right to trial by jury in all legal disputes is forfeited.


Pick Ups & Removals
All items must be removed from the designated pick up location within six (6) calendar days of
auction close. If you are unable to pick up your items within six (6) calendar days of auction
close please make alternative pick up date and time by e-mailing info@primeauctions.ca.
Prime Auctions is unable to store items for more than thirteen (13) calendar days following
auction close.


If alternative pick-up arrangements are not made within thirteen (13) calendar days following
auction close the following will occur:

  • A 20% restocking fee (applicable to invoice total) will be applied to the account and must be paid in full prior to participating in any future auctions

  • Items will be considered forfeited and will be sold to recoup storage costs

  • NO refund will be made to the customer

  • If a bidder fails to pick-up or pay on three separate occasions, then the account will be permanently banned from participating in future auctions​

 

You are required to bring any assistance you will need to pick up your items. Prime Auctions
staff and affiliates of Prime Auctions will not assist in lifting, loading, fixing, packing or
unpacking any of your item(s) or any piece or part of your item(s). You are liable for any
property damage at the designated pick-up location.


Returns
AS-IS and BUY NOW items are sold as-is and no refund will be given on these items.
If a rare scenario arises where an item you have won on our auction was misrepresented in the
listing (we stated it as a different item or condition) or the item was factory sealed but
damaged or incomplete and was not indicated in the listing then we will exchange the item (if
available) or offer a full refund in the form of auction credits if no replacement is available and
the return has been approved by our staff.


We do not accept returns for minor/easy to remedy issues such as missing basic hardware
(generic screws, nuts, dowels, etc.) or paperwork such as manuals even if not stated missing on
the listing.


All returns must:

  • Include the original packaging the item was sold in. We will not accept returns if you do not bring the item back in its original packaging.

  • Notification is made via e-mail to info@primeauctions.ca within six (6) calendar days of auction close

  • Be approved by a manager.

Notification must be made via e-mail to info@primeauctions.ca of any requests for returns and
be returned within six (6) calendar days of auction close in original packaging and condition in
which it was listed and sold. Six (6) calendar days after the auction closes, Prime Auctions no
longer holds responsibility to that item and the return will be denied. Any claims to made to
return the item is void if you remove items from their packages to load in your vehicle and
transport them. Please thoroughly check over any items you remove from packaging during
pick-up at our facility.


The item's description is usually copied from the Retail website we are using for reference. Our
condition notes are our personal opinions or visuals on the item that is being listed. We do not
warrant that products descriptions from major retail sites are accurate, complete, reliable,
current or error free. All MSRPs listed on the site are found with minimal research and taken
from major retailers advertised price. Our comparable prices used are usually taken from
Canadian Retailers with IN-STOCK inventory at the time of listing.

All bidders are encouraged to do their own due diligence on all purchases. Returns will not be
granted if a user "feels or regrets" that they overpaid/overbid for an item.


It is the bidders / buyers obligation to ensure that the item is free of any recalls, or any other
hazard or revocation as provided in the Canada Consumer Product Safety Act (CCPSA)
regardless of statements or claims that are made directly or indirectly by the seller.


These terms and conditions which govern your visit to our website may be changed by us along
with the content of this site at any time. If any of these terms and conditions is deemed invalid,
void or for any reason unenforceable that the terms or conditions shall be deemed severable
and shall not affect the validity or enforceability of any remaining terms and conditions.


Personal & Property Risks
Prime Auctions cannot be held responsible for any harm or damage caused to people or their
belongings. By participating in the auction or purchasing an item, the BUYER agrees to protect Prime Auctions, the Seller, and their assigns from any claims, losses, expenses, damages, or liabilities that result
from the auction, including any negligent acts or omissions by Prime Auctions Inc or any of its
representatives.


Limitation of Liability
Prime Auctions is not responsible for any claims, demands or actions of any nature that may be
suffered by the purchaser, the purchaser's employees, subcontractors or agents, in relation to
the items purchased including the sale, handling, removal, use, dismantling, decontamination
or destruction of the items purchased. The purchaser agrees to hold harmless Prime Auctions
and its employees, subcontractors and agents for any and all claims, demands and actions, in
relation to the items purchased, for which the bidder is legally responsible, including those
arising out of the negligence or willful harm of the purchaser, the purchaser's employees,
subcontractors or agents.


Privacy Policy
Your personal information is collected through our contact forms only. This website currently
has no applications or programs that gather information from your computer without your
consent. Users are required to give us contact information (e.g., address, phone number and
email address) and demographic information (e.g., your postal code) solely for the bidding and purchasing
process. Certain information, such as your email address, is collected in order to verify your
identity and for use in our records. Under no circumstances will your e-mail, phone number or
address be sold to, or given to any other parties. Please contact us at info@primeauctions.ca to
request to be removed from our email list.


We reserve the right to cancel, refuse, disqualify, delete OR adjust any auction item, bid,
bidder, account, or registrant at any time with or without cause. All items sold "AS IS, WHERE

IS" with all faults. By bidding or purchasing an item you are acknowledging agreement with the terms above. Please do not bid or purchase an item unless you agree to all of these terms.
